what happens when you double click on your background layer? Sometimes in doing so you can convert it to just a regular layer (not a background). Photoshop will usually name this "Layer 0." From there you should be able to duplicate the layer (by right clicking it, then pressing "duplicate") which will get rid of any funny stuff.
Background layers are generally locked by default. By converting it to a regular layer (through the process I just described) it should remedy the situation.
